Gary Schultz set to file lawsuit against woman who claimed to represent him in court

Gary Schultz, a former Penn State executive accused of covering up complaints about Jerry Sandusky, took action to start filing a lawsuit against the woman who allegedly pretended to be his lawyer when he needed it most.

Gary Schultz filed what's called a writ of summons in Centre County Court, against Cynthia Baldwin. It explains the allegations he's making against her and states he intends to sue her for malpractice.

Former Penn State Executive Gary Schultz, accused of covering up complaints about Jerry Sandusky, made a civil court filing suggesting a lawsuit is being prepared against Cynthia Baldwin. She's the university's former attorney.

Schultz claims he thought Baldwin was his lawyer and allowed her to represent him at the Grand Jury proceedings two years ago. But at those same proceedings, she also testified against Schultz.

That's why now he plans to sue her for malpractice. Former Attorney General Walter Cohen says he's not surprised Schultz is filing the lawsuit.

"The process itself depends on lawyer/clients privilege and right of an individual to be represented by council,” explained Cohen. “In this case Cynthia Baldwin went into the grand jury after being sworn in front of a judge and indication to that judge that she represented Mr. Schultz and Mr. Curley, she went into the grand jury as their lawyer. They felt they were represented by her, she turned against them, testified in front of same grand jury against them, telling the grand jurors what they told her in confidence."

Cohen, who will be an expert witness for Schultz and Curley if and when they go to trial, says he wouldn't be surprised if Tim Curley files a similar lawsuit in the near future.
