Lawyers of Penn State, Mike McQueary in court over whistleblower case

One of the fall out cases from the Jerry Sandusky child sex abuse case was in a Centre County court room Friday.

Mike McQueary’s lawyers and attorneys for PSU argued about whether his whistleblower and defamation case should be delayed.

McQueary himself was not in court Friday, but his attorneys argued his case should not be delayed. They added he has a constitutional right to a speedy trial.

But Penn State attorneys say it needs to be delayed until the cases against the university’s top leaders are resolved. At this point we still don't know which way the judge will go.

Attorneys for Mike McQueary and for Penn State left the Centre County Court House with no comment.

But inside, McQuearys attorney read from the Pennsylvania constitution, saying that Penn State’s attorneys have a bunch of maybes on their side, but they have the constitution which promotes a speedy trial.

Penn State's attorneys outlined seven reasons to grant the stay, many involving the ongoing criminal trials of Graham Spanier, Tim Curley and Gary Schultz.

They argued the three would invoke their right not to testify and pointed out 33 paragraphs of overlap between their criminal trial and McQueary’s civil trial.

McQueary is suing the university for four million dollars, alleging his reputation has been ruined and he was terminated because of his cooperation with investigators in the Jerry Sandusky case.

McQueary testified he saw Sandusky in a Penn State shower in 2001, sexually abusing a boy. Curley, Schultz and Spanier face charges for failing to properly report that allegation.

The judge took notes and asked questions throughout the hearing. Again he says he will decide whether to grant a stay in McQueary’s whistleblower case within two weeks.
