UPDATE:
In the Jerry Sandusky child sex abuse scandal, Thursday's a big day in court for the two top Penn State officials charged in the case. Gary Schultz and Tim Curley are charged with perjury and failing to report suspected child abuse.
They'll ask for all charges to be dismissed, but they won't stop there.
Judge Todd Hoover at the Dauphin County courthouse is setting aside three hours Thursday. Starting at nine in the morning, he'll hear from attorneys for both men and those with the Attorney General’s office.
Lawyers for Gary Schultz and Tim Curley will not only ask a judge to drop all charges, they'll also ask for specific evidence which they say the Attorney General's office never gave them.
Schultz, the retired Penn State Vice President, and Curley, the former Athletic Director are charged with perjury and failing to report suspected child abuse involving former assistant football coach Jerry Sandusky, who was convicted and sits behind bars.
“I thought that this would be a good case to defend, prior to those emails,” stated criminal defense attorney Korey Leslie.
The emails are the ones that the Freeh Report released and the ones that reveal Curley and Schultz were among four top Penn State officials who knew exactly what they were doing, allegedly helping to cover up the serial rapist's actions.
“Those emails could obviously damage their case severely if they are talking about whether of not they should take this to the authorities because obviously we know they didn't,” Leslie added.
Lawyers for Curley and Schultz also want notes which agents and investigators took down while interviewing witnesses.
“Those attorneys want to see the written notes because sometimes the agents leave out certain things they don't think is important or relevant,” Leslie concluded.
Curley and Schultz are not expected to be in court Thursday for the pretrial motion hearing. CBS 21 News will be there and bring you the latest on what happens in the court room

A Dauphin County Judge will hear arguments on pre-trial motions in the case of two Penn State University administrators charged with perjury and failing to report suspected child abuse.
The judge is expected to hear many arguments from the lawyers of Gary Schultz and Tim Curley at the Dauphin County courthouse Thursday morning starting at 9 a.m.
Their lawyers will argue that there isn't sufficient evidence to proceed with charges that may be related to Mike McQuery's timeline of events of what he saw. Lawyers for both Schultz and Curley will ask all charges be dropped.
McQuery testified during Sandusky's trial that he witnessed what he thought was Sandusky raping a young boy in the shower, but did not intervene.
Thursday, the lawyers will also ask for specific evidence that was not turned over by the Attorney General's office.
They'll also request notes, which agents and investigators took down while interviewing witnesses.
Retired Penn State Vice President Gary Schultz and former Athletic Director Tim Curley were two key figures listed in the Freeh Report, which revealed that reports of Sandusky's actions were hidden by Penn State officials.
It's unclear if Curley or Schultz will be in court Thursday, but CBS 21 News will be there and bring you the latest information on what happens in court.
