Family settles for $900,000 after taser death

The family of a man, who died after being tased by police more than a dozen times, will get a nearly million dollar settlement.   It was 2010 when Robert Neill Jr. died, his family has always said the force and tasing used on him was excessive and led to his death.

Mount Joy Borough Council approved the $900,000 settlement Monday night.

It was Robert Neill Jr, himself, who called police on an early November morning in 2010.  He was complaining about a neighbor harrassing him and a stolen bicycle.

But the 61-year-old ended up dead after police responded to his Harvestview apartment.  They claim he became combative and had to be restrained.

His family says police shocked Neill several times from a distance with electrode-tipped barbs, and then several more times directly with a stun gun.  His family also claims he was pepper sprayed and hogtied.

The State Attorney General's office says it found no evidence of police wrongdoing.

Neighbors and friends told CBS21 News Neill Jr. was a highly decorated Vietnam war veteran and belonged to the "Vietnam Veterans of America." in Lancaster.

The settlement was recommended by the Borough's insurance company. The officer involved was fired for violating the departments use of force policy.

He also is suing the Borough, saying his due process rights were violated.
