The decision by Troopers Joseph M. Kozuch and Jeremiah R. Mistick to commence and continue the pursuit of the vehicle driven by Hector Gonzalez was not reckless as defined under Pennsylvania law. Instead, it was an appropriate action when balancing the risk to public safety. The officers are to be commended for their prompt efforts, although unsuccessful, to locate and assist Mr. Gonzalez after the accident. Accordingly, no criminal action or professional misconduct charges are warranted.
