Dauphin County District Attorney will investigate Harrisburg debt if he finds evidence of wrongdoing

The Dauphin County District Attorney says he will work with three State Senators who led a two-day public hearing into why Harrisburg's incinerator is more than $300 million in debt.

DA Ed Marsico told CBS 21 News, that before he can launch a formal investigation, he needs some evidence of criminal wrongdoing.

Marsico says he has monitored the incinerator financial crisis for years. He promised to take a look at the information gleaned from the hearing as well as the forensic audit and then determine whether a criminal investigation is warranted by his office or another law enforcement agency.  "As a former mayor, you know sometimes there's bad decisions made in government that lead to a crisis like we have in the city of Harrisburg.  Does it violate a criminal statute is my charge as District Attorney. I'm bound by law in that regard and any evidence that would lead to a violation of that."

State Senator Mike Folmer is one of the three that asked the Senator to review the testimony.  "This is very frustrating. i think it's very disconcerting from a good government position. there are some things that really need to be looked at. i am encouraged though that the da is picking this upend take a look into it."

The DA says many of the players are local individuals he's had different relationships with. If he decides a criminal investigation is warranted, he will also decide where he has a conflict of interest and should refer the case to another agency

Marsico said the letter from the Senators was to let him know that the transcripts of the hearing testimony are now public record. and that they would defer to his judgment as to whether further review is necessary.  "When somebody calls for an investigation we need specifics. I can't either myself or refer to another agency and say hey, go investigate Kirk Wilson. For what?"
